1. Who we are

This website, oomel.com (the "Site"), is operated by Oomel Active, trading as oomel ("we", "us", "our"). Our address is 321-323 High Road, Romford, RM6 6AX, United Kingdom, and you can reach us at active@oomel.com. By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site.

2. Eligibility and accounts

You must be at least 18, or the age of majority where you live, to place an order. You're responsible for keeping your account details secure and for all activity under your account. Please give accurate, complete information when you order.

3. Products and photos

Our campaign and product photos are styled on digital models. We work to show each product's design, cut and color accurately, but colors can look different on different screens and small variations between production batches can occur. Measurements in our size guide are approximate. Product descriptions are not a warranty beyond what the law requires.

4. Prices and payment

Prices are shown in US dollars unless your checkout shows another currency, and may change at any time before you order. Taxes, shipping and any duties shown at checkout are added to your total. We accept the payment methods shown at checkout. Installment payments, where offered, are provided by a third-party lender (such as Shop Pay Installments, provided by Affirm) under that provider's own terms and subject to approval.

5. Orders

Your order is an offer to buy. We accept it when we ship it and send you a shipping confirmation. We may refuse or cancel an order, for example if an item is unavailable, if there is a clear pricing error, or if we suspect fraud. If we cancel after you've paid, we refund you in full.

6. Shipping and delivery

Our products are made and shipped by our production partners in China. Delivery estimates, costs, customs and duties are explained in our Shipping Policy, which forms part of these Terms. Orders are processed within 1 to 5 business days, and delivery takes 5 to 8 business days after your order ships. If we can't ship within the time we stated, we'll tell you and offer you the choice to cancel for a full refund. Risk of loss passes to you on delivery.

7. Returns and refunds

Returns, exchanges and refunds are covered by our Refund Policy, which forms part of these Terms. Nothing in these Terms limits any rights you have under the consumer law of your country, including any statutory right to cancel a distance purchase.

8. Disputes about a charge

If something is wrong with your order or a charge, please email us first at active@oomel.com. We reply within one business day and can usually fix it faster than a bank dispute. This does not limit your rights with your card issuer.

9. Use of the Site

You may not use the Site for anything unlawful, to interfere with its security or operation, to copy or scrape its content, or to submit false orders or information. All content on the Site, including text, images, graphics, logos and the oomel name, belongs to us or our licensors and may not be used without our written permission.

10. Reviews and content you send us

If you send us reviews, photos, ideas or other content, you give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our business. Please don't send content that is unlawful, misleading or that you don't have the right to share.

11. Third-party services

The Site runs on Shopify, and payments, installments and delivery are handled by third parties. Their own terms and privacy policies apply to their services, and we are not responsible for them.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, and our total liability for any order is limited to the amount you paid for it. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

How we handle your personal information is explained in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The version on the Site when you place an order applies to that order.

15. Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.
